The Partial Birth Abortion Ban Act defines "partial birth abortion" as, "An abortion in which the person performing the abortion, deliberately and intentionally vaginally delivers a living fetus until, in the case of a head-first presentation, the entire fetal head is outside the body of the mother, or, in the case of breech presentation, any part of the fetal trunk past the navel is outside the body of the mother, for the purpose of performing an overt act that the person knows will kill the partially delivered living fetus; and performs the overt act, other than completion of delivery, that kills the partially delivered living fetus." (18 U.S. Code 1531)

The partial birth abortion, also called "brain suction" or the "D&X" method, is performed after 4 or 5 months. 80% of the babies are normal and viable. This method is similar to a breech delivery. The entire infant is delivered except the head. Then A scissors is jammed into the base of the skull and tube is inserted into the skull, enabling the brain to be sucked-out and allowing the skull to collapse. The dead infant is then pulled out and disposed of.
